Rules for Power of Attorney
Eligible documents include notarized or officially issued Virginia documents
Virginia will authenticate POAs (and other documents) that are either notarized by a Virginia-commissioned notary or issued/certified by a Virginia state or court official.
Notarization must meet all statutory requirements
Notarization must include county/independent city name, notarization date, valid notarial statement, notary signature, commission expiration date and registration number, and a photographically reproducible seal matching records.
Only original notarizations/certified copies within 12 months are accepted
Notarized or issued documents must not be older than 12 months, and photocopies or scanned copies are not accepted.
Vital records and court-issued documents have special requirements
Vital records must come directly from the Virginia Dept. of Health or DMV; court records must carry a “Triple Seal” or Certification of Official Record, not be notarized.
Apostille/authentication fee and schedule
The fee is $10 per document (not per page), with $10 for the first document signed by an official and $5 for each additional document signed by the same official on the same date.
Submission requires a cover letter stating the destination country
You must include a cover letter naming the country where the document will be used so the office issues Apostille (Hague) or Certification (non-Hague) accordingly.
Federal or out-of-state documents are not eligible
Documents issued by federal agencies or notarized outside Virginia must be authenticated by their state/country of origin or by U.S. Department of State — Virginia will not process them.
Authorization by the Secretary of the Commonwealth does not validate content
The authentication only certifies the notarization or official seal/signature — it does not verify or validate the contents of the POA.
