Determine the Correct Agency
This is the most critical step. The correct department is determined by the office that issued your certified marriage certificate: NYC Department of Health (Vital Records): For certificates issued in the five boroughs of New York City (Bronx, Brooklyn, Manhattan, Queens, Staten Island). NY Department of State (DOS): For certificates issued anywhere else in New York State.
Certified Document
You must submit an original certified copy with a raised or stamped seal from the issuing authority (NYC Health Department or a NYS County/City Clerk).
Notarization is REQUIRED (Critical Step)
The certified marriage certificate must be notarized by a New York Notary Public before submission. Rejection Cause: Sending the document without this notarization. The agencies apostille the notary's signature.
Complete the Correct Form & Payment
For NY Department of State (NYS): Use the "Authentication Request Form". Fee is $10.00 per apostille. Make check/money order payable to "Department of State." For NYC County Clerk (for NYC docs): You must first get the notarized document certified by the NYC County Clerk (in the borough where it was issued). The County Clerk's fee is approximately $3.00. Then, send it to the NY Department of State with their $10.00 fee and request form.
