Rules for Power of Attorney
The POA must be an original notarized document or certified recorded instrument
New Mexico only accepts originals or certified copies; photocopies cannot be authenticated
The notarization must be performed by a New Mexico–commissioned notary
The Secretary of State cannot authenticate POAs notarized outside New Mexico.
Vital records cannot be notarized for authentication purposes.
Birth, death, and marriage certificates must be certified copies from the NM State Registrar.
Apostilles/Certificates are attached using a permanent eyelet
Removing the eyelet voids the authentication and makes the document invalid.
Only the New Mexico Secretary of State can issue Apostilles or Certificates for NM-notarized documents
POAs notarized in another state must be authenticated by that state’s authority.
