Rules for Power of Attorney
Eligible documents include POAs and other state-issued or notarized NC documents
NC will authenticate public records and notarized documents (including POAs) as long as the document is issued or notarized under NC law.
Notarization (when required) must follow North Carolina notary rules
If a POA is private (not from a state agency), it must be signed before a North Carolina Notary Public; school transcripts must also be notarized — a school seal alone is not enough.
Some public-agency documents don’t need notarization
Documents from a NC Register of Deeds, Clerk of Superior Court, Vital Records, Health Dept., DMV (Raleigh office), etc., are valid without notarization.
Copies require a “True Copy” affidavit
If you’re submitting a copy instead of the original, you must include a notarized “True Copy” affidavit stating it's a true copy of the original.
Request submission must include cover letter, payment, and return envelope/label
When you submit a POA for apostille/authentication, include a cover letter (with destination country), check/money order, the original document(s), and a prepaid return envelope or carrier label.
Apostille / Authentication fees
The standard fee is $10 (US currency) per document submitted for apostille/authentication.
Translation requirement if not in English
If the POA (or any document) is not in English, you must submit a certified or notarized English translation along with the document.
Apostille for Hague countries; additional authentication needed for non-Hague countries
If the destination country is a Hague Convention member you receive an Apostille; if not, NC issues a certificate and you must then submit to the U.S. Department of State for further authentication.
