Document Requirements for a Power of Attorney
Your POA must meet all Florida authentication requirements, including: The POA must be an original notarized document. Photocopies are not accepted. The notarization must include: A complete notarial statement The notary's original signature The notary’s stamp and seal If the POA was issued or certified by a Florida Clerk of the Court, it must be an original certified copy—no photocopies. Florida does not accept scanned, emailed, or electronically notarized POAs unless the notarization fully complies with Florida’s statutory e-notarization requirements and is accepted by the receiving country.
Filing Process for a Power of Attorney
To authenticate or apostille a Florida POA, you must submit: A completed Apostille and Notarial Certificate Request Form Your original POA A return envelope Self-addressed and stamped, OR A pre-paid, pre-addressed airbill with your name listed as both sender and recipient Required payment All materials must be mailed to the Florida Department of State – Division of Corporations, Apostille Section.
Fees
Florida charges the following: $10.00 per POA document $20.00 per POA document notarized by a Florida Clerk of Court This includes: $10 apostille fee $10 certificate of incumbency (verifying the Clerk’s authority) These fees apply whether the document requires a Hague apostille or a non-Hague certification.
Notarization Requirements
Florida will only apostille a POA if: The notarization is performed by a Florida commissioned notary public The full notarial certificate is included (e.g., acknowledgment or jurat) The notary’s seal and signature match the commission on file No alterations or corrections appear on the POA without proper initials and re-notarization
Important Notes
Photocopies of POAs are never accepted for authentication. A POA notarized outside Florida must be authenticated by that state, not Florida. The return method must be pre-paid; Florida does not cover outbound shipping.
