Document Requirements for a Power of Attorney
Your Power of Attorney must meet all of the following: It must be properly notarized by a Delaware Notary Public. Remote or electronic notarization is not accepted. If the POA is in a foreign language, you must provide: An English translation, and Both versions (original and translation) must be notarized. If the POA has been filed with the Delaware Secretary of State, each document must be certified separately. Delaware will not issue an apostille for documents grouped under a one-cover certification.
Official Signatures Accepted
The Division of Corporations can authenticate documents bearing the signature and seal of any Delaware public official, including: Delaware Notaries Public Officials whose signatures are already filed with the Secretary of State The country of destination determines whether your POA requires: an Apostille (for Hague Convention countries), or a Non-Hague Authentication (for all others)
Apostille/Authentication Fees
Delaware charges a flat fee of $30.00 per document, whether the POA is: For personal use (e.g., birth/death certificate, adoption), or For commercial/business use Expedited processing is available for an additional fee.
Notarization Requirements for POA
When notarizing a Power of Attorney: The notary’s signature and commission must be valid and verifiable. The notary may be asked to provide proof of commission (which can be obtained from the Delaware Secretary of State if required by the receiving country). Remote/online notarized POAs will not be accepted for apostille.
