Rules for Death Certificate
Must Be a Certified Copy
You must submit an original certified copy issued by the Delaware Department of Health and Social Services, Division of Public Health, Office of Vital Statistics. It must have the official seal and the signature of the State Registrar. Photocopies are not acceptable.
Certificate Must Be Recent
Delaware enforces a strict recency requirement. The certification date on the vital record must be within one year of the date it is submitted to the Delaware Secretary of State for the apostille.
Do Not Notarize the Certificate
The certified death certificate itself should not be notarized. The apostille is applied directly to the document based on the signature of the State Registrar, which is already on file with the Secretary of State. Notarizing it will invalidate it for this process.
