Rules for Power of Attorney

• Document Requirements for a Power of Attorney

  Your Power of Attorney must be an original document, and it must include one of the following: A Colorado Notary Public’s signature and seal (most common for POAs) OR Certification issued by Colorado Vital Records (generally for vital records, rarely for POA) OR Certification by a Colorado County Clerk (applies only if the POA is part of a recorded public document) Photocopies of a POA cannot be apostilled unless they are certified as true copies by the appropriate Colorado office.

• Required Form

  When submitting a Power of Attorney for authentication, you must include: A completed Apostilles & Authentications Request Form (PDF) The original notarized POA

• Fees

  Fees must be paid by: Check or Money Order payable to Colorado Secretary of State

• Submission Options

  By Mail Send all items to the address printed on the Apostilles & Authentications Request Form. In Person You may submit your Power of Attorney directly at the Colorado Secretary of State office.

• Notes

  Colorado requires original signatures — electronic or scanned copies cannot be authenticated. POAs notarized outside Colorado cannot be processed; they must be authenticated by the state in which they were executed.
