Rules for Divorce Decree
County Certification is Mandatory
The state will not apostille a document signed only by a judge or court clerk. You must first have the certified divorce decree authenticated by the Probate Judge in the same county where the divorce was granted. This is the most common reason for rejection.
Use a Certified Copy
You must submit the original "Certified Copy" of the Divorce Decree issued by the Circuit Clerk's office, bearing the court's raised seal. Photocopies or notarized copies are invalid for an apostille.
Complete the Official Form
The "Authentication / Apostille Request Form" must be fully filled out, including the correct destination country, and be signed and dated.
Include Correct Payment
The fee is $5.00 per document. Payment must be by check or money order payable to "Alabama Secretary of State." Cash is not accepted.
